South Carolina Contractor License Requirements
South Carolina runs two licensing tracks under one department (LLR) with three dollar thresholds. Commercially, the Contractor's Licensing Board requires a General or Mechanical Contractor licence whenever the total cost of construction is greater than $10,000 (S.C. Code § 40-11-30 — raised from $5,000 in 2023); the licence is held by an entity qualified by a person who must score 70% or better on the technical and SC-law exams, and it must be backed by the net worth of one of five license groups or a surety bond in lieu, renewed biennially. Residentially, the Residential Builders Commission licenses a residential builder above $5,000 (≤3 floors, ≤16 units) and issues residential specialty credentials above $500 — a licence after exam for plumbers, electricians and HVAC, a no-exam registration for the rest.
01 The model: two tracks, three thresholds
- Track 1 — commercial, the CLB — § 40-11-30 bars general or mechanical contracting over $10,000 without a licence. S-SC-40-11
- Track 2 — residential, the RBC — a residential builder licence above $5,000 for buildings ≤3 floors and ≤16 units (§ 40-59-20(6)). S-SC-40-59

- Both boards sit under LLR — the same department administers fees, renewals and the public licence lookup for both tracks.
02 Track 1 — the Contractor's Licensing Board (commercial)
- Threshold — "No entity or individual may practice as a contractor … for which the total cost of construction is greater than ten thousand dollars … without a license" (§ 40-11-30). At or under $10,000 there is no CLB licence to hold. S-SC-40-11
- Qualifying party — 70% or better on the technical exam for each classification and on the SC-law exam; the primary qualifying party also needs 2 years full-time experience within the previous 5 years (§ 40-11-230). Exams are administered by PSI. S-SC-40-11

- Entity licence — the licence is held by an eligible entity (sole proprietorship through corporation) with "a certified qualifying party in a responsible management position" (§ 40-11-240). S-SC-40-11
- Financial floor — net worth OR working capital for the license group (§ 40-11-260): General groups 1–5 run $20k → $350k net worth, Mechanical $7k → $300k. S-SC-40-11
- Surety bond in lieu — § 40-11-262 lets the applicant post a bond "in the same amount as the net worth for the applicant's license group" instead of the financial statement, with the State of South Carolina as obligee and 30 days' cancellation notice. S-SC-40-11
- License group ceiling — the group fixes the maximum job size (GC group 1 = $100k … group 5 = unlimited); contracting beyond it is grounds for discipline (§ 40-11-110(A)(21)). S-SC-40-11
- Biennial renewal — all CLB licences renew every two years with a 90-day retroactive grace (§ 40-11-250); General Contractors expire 10/31 of even years, Mechanical Contractors 10/31 of odd years. S-SC-40-11
- Enforcement — unlicensed practice is a misdemeanour (≤1 year and/or ≤$5,000, § 40-11-200), with administrative penalties of $500 / $1,000 / $2,500 per day (§ 40-11-100) and discipline for missing net worth or over-group contracting. S-SC-40-11
- Administrative penalties — up to $500 for a first violation, $1,000 for a second within five years, $2,500 per day in total, plus a civil penalty of up to $5,000 per violation for board discipline (§§ 40-11-100, 40-11-110(C)). S-SC-40-11
- Discipline — (15) failure to maintain net worth, working capital or the surety bond, and (21) contracting beyond a group's limitations or outside a classification; re-application waits one year after revocation (§ 40-11-110). S-SC-40-11

03 Track 2 — the Residential Builders Commission (residential)
- Residential builder licence — required to construct, superintend or offer to construct a residential building ≤3 floors and ≤16 units "when the cost of the undertaking exceeds five thousand dollars" (§ 40-59-20(6)). S-SC-40-59

06 Conflict and verified absences
S.C. Code Ann. § 40-59-20(6) (read 2026-10-05 from scstatehouse.gov): "'Residential builder' means one who constructs, superintends, or offers to construct or superintend the construction, repair, improvement, or reimprovement of a residential building or structure which is not over three floors in height and which does not have more than sixteen units in any single apartment building, when the cost of the undertaking exceeds five thousand dollars. Anyone who engages or offers to engage in such undertaking in this State is considered to have engaged in the business of residential building.' Read alone, a two-storey house costing $12,000 is squarely a RESIDENTIAL BUILDER matter (over $5,000, within the floor/unit limits).
