Utah Contractor License Requirements

Utah licenses engaging in a construction trade for compensation — not a dollar value of work — through one statute (Title 58, Chapter 55, "Contractors") and one agency, DOPL's Division of Professional Licensing. Above $7,000 of alteration, repair, remodeling, addition or improvement (labor, materials and every change counted) the contractor licence duty attaches — general classifications B100, R100, E100, H100, P200, P201, E200 and E201 each need 2 years / 4,000 hours of paid experience, the 25-hour prelicensure course + 5-hour business-and-law course and the Utah Contractor Business and Law Examination (ProV). Below the line the building work is exempt — but the statute's seven trade overlays (plumbing, electrical, HVAC, gas, fire suppression, alarm, radon) stay attached at any value, and between $3,000 and $7,000 a one-time handyman affirmation with $1M/$3M insurance is required. Seventeen no-exam specialties (S280 roofing, S202 solar, R101 remodeling and 14 more) form the contractor ladder's other half — capped at three per licensee. Renewal is biennial, November 30 (odd years for contractors, even for trades) with 6/16/12/8 CE hours.

01 The model: one act, one division, a $7,000 line

LICENCE DUTY (58-55-301)|$7,000 EXEMPTION (58-55-305)|LOCAL PERMITS (15A-1-205)
  • The licence duty is on the TRADE, not the price — 58-55-301(1)(a): engaging in the construction trade as a contractor requires a licence; the statute licenses the trade itself, and the only dollar figure in Chapter 55 is the exemption line, not a threshold. S-UT-CODE-55
  • Preemption with one preserved local power — 58-55-301(1)(b)-(c): a political subdivision may require only a local business licence in addition to the state licence (or its fee), may not require a second contractor licence for work the state licenses — but building permits and their fees survive untouched. S-UT-CODE-55
  • Permits are the local compliance layer — 15A-1-205(2): the state issues no building permits and assess no permit fee; the local building official is the permit authority, and applying for a permit while unlicensed is itself unlawful conduct under 58-55-501(7). S-UT-CODE-15A
  • One agency, two credential surfaces — DOPL administers both the contractor classifications (8 general + 17 specialty) and the individual trade licences (five electrician and five plumber tiers plus elevator mechanic); there is no separate mechanical, electrical or plumbing board in Utah. S-UT-R156-55A

02 The $7,000 line and its carve-outs

  • The exemption itself — 58-55-305(1)(h)(i): alteration, repair, remodeling, addition or improvement of an existing building under $7,000, measured "including labor and materials, and including all changes or additions to the contracted or agreed upon work" — so a job that crosses the line mid-project loses the exemption. S-UT-CODE-55
  • The $3,000 affirmation band — between $3,000 and $7,000 the exempt person must file the one-time handyman exemption affirmation ($45) and carry liability insurance of $1,000,000 each incident / $3,000,000 total, reaffirming every odd-year November 30; under $3,000 neither the affirmation nor the insurance attaches. S-UT-R156-55A
  • Seven trade overlays never leave — 58-55-305(1)(h)(ii): a project that "involves an electrical or plumbing system" must go to a licensed electrical or plumbing contractor (component work — "a faucet, toilet, fixture, device, outlet, or electrical switch" — may be done by a licensed journeyman), HVAC "must be performed by an HVAC contractor licensed by the division" even below the line, gas work needs a Certified Natural Gas Technician, fire suppression, alarm and radon work keep their own conditions. S-UT-CODE-55
  • Owners and the 28 rule-exempt activities — an owner-occupant may build one residential structure per year and three per five years (58-55-305(1)(j)); R156-55a-301an lists the licensed-person exemptions (supervised students and interns, carpet/vinyl/turf installation, concrete cutting, tree work, lawn care, standalone solar systems and more). S-UT-CODE-55 S-UT-R156-55A

03 The application ladder — general vs specialty

  • Experience — 2 years / 4,000 paid hours for B100/E100/R100/P200/P201/ E200/E201, with five alternative doors (qualifier on a Utah licence ≥2 years, construction-management degree, Utah PE, NASCLA exam, one year out-of-state active); specialty contractors owe NO experience. S-UT-DOPL-GC S-UT-DOPL-FAQ
  • The course ladder — 25 hours, +5 for general classes — the 25-hour prelicensure course (ABC, UHBA or AGC providers) for every contractor classification, plus the 5-hour business-and-law course for the general classes unless the 25-hour course predates 2019-10-01. S-UT-DOPL-SC
  • One division exam — the Utah Business & Law — ProV-administered for B100/E100/H100/R100/E200/E201/P200/P201; specialty contractors and apprentices owe no division exam at all; H100 additionally owes the HVAC written exam. S-UT-DOPL-EXAM
  • Qualifiers — the qualifier must be on site at least 12 hours a week with material authority; 10 days to notify a departure, 60 days to replace (or the licence is at risk); E200/E201 qualify through a master electrician, P200/P201 through a master plumber (E201/P201 also accept the residential master tiers). S-UT-CODE-55 S-UT-CODE-55
  • The specialty rules — three specialty licences maximum per licensee, and R101 may not be held with any other specialty (R156-55a-301am(3)(c)); R101 itself caps at $50,000 non-structural work. S-UT-R156-55A
  • H100 — the heaviest entry in Utah — effective 2026-04-20: RMGA (or equivalent) certification, both ProV exams, and two years of W-2-verified HVAC-specific experience (R156-55a-302g: 4,000 HVAC hours at ≥90% workload). S-UT-DOPL-CON
  • Forward-looking: fingerprints from 2027-01-01 — new law requires fingerprint-based background checks for qualifiers and every owner holding ≥10%.S-UT-DOPL-CON
  • No reciprocity — endorsement instead — Utah has no reciprocity agreement with any state; licensure by endorsement judges the out-of-state licence and any discipline history. S-UT-DOPL-FAQ

04 Insurance and financial responsibility

  • General liability $1M each incident / $2M total — R156-55a-302d (eff. 2026-04-20) requires the certificate for the entire duration of active licensure with DOPL as certificate holder; the pre-2026-04-20 specialty page said $3M aggregate (CONFLICT-UT-001), and $3M survives as the handyman affirmation's own aggregate. S-UT-R156-55A
  • Workers' comp or waiver — required where the licensee has employees (or owner-workers under 8%); otherwise a Labor Commission waiver substitutes, plus the Workforce Services and Tax Commission registration numbers or an approved PEO contract. S-UT-R156-55A
  • Financial responsibility — questionnaire first, bond only in lieu — §58-55-306 defaults to the signed questionnaire; a surety bond attaches only where cumulative debts reach $1,000, at R156-55a-602's tiers: greater of 30% of debts or $50,000 (general classifications), $25,000 (R100) / $15,000 (other); unincorporated entities may post 20% of annual gross distributions instead. Utah has NO universal licence bond. S-UT-CODE-55

05 The cycle: November 30 and the CE ladders

  • Biennial renewal, split odd/even — "All contractor licenses expire on November 30th, of each odd year" (DOPL FAQ verbatim); electrician, plumber and elevator licences expire November 30 of even years. $128 renewal, $20 late, $50 reinstatement (over two years late, a fresh application). S-UT-DOPL-FAQ
  • Contractor CE — 6 hours, 3 live — per two-year cycle, at least 3 core and at least 3 live in-class (R156-55a-303b); HVAC licensees owe 3 HVAC-specific hours, landscape licensees 1 of water-conservation/fire-risk. S-UT-DOPL-REN
  • Trade CE — 16 / 12 / 8 — 58-55-302.7(2): electricians 16 hours (12 core: 8 NEC + 4 NFPA 70E), plumbers 12, elevator mechanics 8, per two-year cycle. S-UT-CODE-55
  • The licence rides the entity registration — the contractor licence depends on the entity's current Division of Corporations & Commercial Code registration; let the registration lapse and the licence lapses with it. S-UT-DOPL-FAQ

06 Duties, overlays and penalties

  • Unlicensed contracting is a class A misdemeanor — 58-55-503/504: citation fines up to $1,000, $2,000 and $2,000-per-day for a continuing violation; 58-55-501 lists the unlawful-conduct acts including bidding and applying for a permit while unlicensed. S-UT-CODE-55
  • Lending the licence is a class A misdemeanor too — and paying an unlicensed worker on a 1099 to avoid the regime is its own violation; business names must match the licensed name on record. S-UT-DOPL-FAQ
  • Gas, fire and elevator overlays sit on top — 58-55-308: gas appliance and combustion work needs a Certified Natural Gas Technician qualifier; S370 fire suppression has its own exam route; S510 elevator contractors qualify through an active Utah Elevator Mechanic licence. S-UT-CODE-55
  • Crane operators need certification — NCCCO (or division-approved) certification under 58-55-504; violation is a class A misdemeanor. S-UT-CODE-55
  • Liens: the 20-day preliminary notice — under the State Construction Registry (38-1a-501), a preliminary notice within 20 days of first furnishing labor or materials preserves lien rights; later and the lien is lost. S-UT-CODE-38
  • The Residence Lien Recovery Fund cannot pay claims — qualified beneficiaries register automatically, the initial assessment ended 2018-05-08, and DOPL publishes that available funds are "extremely limited or may be unavailable." S-UT-CODE-38
  • Consumer and directory duties — home solicitation sales carry a three-business-day cancellation right (Title 70C ch. 5); the Construction Business Registry is a free, opt-in public directory (58-55-702), never a licence. S-UT-CODE-70C S-UT-CODE-55

PUBLISHED at $2,000,000 aggregate — the rule text, the 2026-04-20 announcement and the current application PDF agree, and the $3M page predates the change; both figures are seeded side by side (REQ-UT-INSURANCE-001 + INS-UT-CGL-001 carry the current one, this row carries the superseded one).

Analysis notes

The $3,000,000 aggregate did NOT disappear from Utah law — it survives as the HANDYMAN affirmation's own requirement (R156-55a-305a: liability '$1,000,000 for each incident and $3,000,000 in total' for exempt work between $3,000 and $7,000). The two figures coexist because they govern different documents; this row exists so no reader mistakes one for the other.

BOTH NAMES PUBLISHED: H100 is the current classification (seeded as ut:h100) and the S350 name is carried inside its transition note and here — the recognition window runs to 2027-11-30, so both remain true for different licensees.

Analysis notes

The statewide renumbering by Chapter 42 (2026 GS), effective 2027-01-01, will fold this into new Part-1 numbering; this seed uses CURRENT numbering throughout and flags the future text as forward-looking.

retrieved 2026-10-11

NEITHER FIGURE SEEDED — no FEE-UT-RLRF row exists. The statutory text says qualified beneficiaries (the contractor classifications) register automatically, so a '$330 registration' line cannot be published as a contractor duty against DOPL's own no-assessment statement without a DOPL correction notice.

Analysis notes

The honest outcome is the withheld row: the fee page names the tension instead of guessing which side is stale. If DOPL reconciles the schedule with the programme page, this row retires and the amount seeds then.

  • No dollar threshold for licensure — Utah licenses the trade, not the project value; the $7,000 figure is only the alteration/repair exemption of 58-55-305(1)(h)(i), and $3,000 only the affirmation trigger inside it. S-UT-CODE-55
  • No universal surety bond — financial responsibility defaults to the signed questionnaire; the R156-55a-602 bond tiers bite only where cumulative debts reach $1,000. S-UT-CODE-55
  • No mechanical board and no handyman licence — HVAC is the H100 contractor classification; no "handyman" appears anywhere in Chapter 55 (machine-checked), yet the fee schedule prices a "handyman exemption registration" — its legal basis is published as open, never guessed. S-UT-DOPL-CON
  • No reciprocity and an exhausted recovery fund — Utah offers endorsement, not reciprocity; the LRF has taken no initial assessment since 2018-05-08 and DOPL publishes that it cannot pay new claims. S-UT-DOPL-FAQ S-UT-CODE-38
  • R100 has no published dollar ceiling — "small commercial" is measured in stories (≤3) and square feet (≤20,000), and the R156-55a extraction cut off inside the scope — no cap beyond the published limits is invented. S-UT-CODE-55
  • The municipal layer stays untouched — no Salt Lake City or other Utah municipal fee schedule was opened; every city fact stays LOCAL_AUTHORITY_REQUIRED. S-UT-CODE-15A
